In July, Representative Andy Barr of Kentucky introduced the Winnings and Gains Expense Restoration (WAGER) Act of 2025, legislation that would enable people who wager to fully deduct their wagering losses against their winnings.
Without successful passage of this bill, only 90% of wagering losses would be eligible for federal tax deductions. Horseplayers could end up being unfairly taxed on a percentage of their losses, decreasing handle, and threatening thousands of jobs in the horse racing industry.
